« La relation de la personne avec les choses constitue le droit des biens. Elle occupe une place centrale dans la vie sociale. La croissance économique puis la décroissance, l'écologie, le partage des ressources et des richesses, l'exode rural... éprouvent directement cette relation. Il n'est pas étonnant que des concepts nouveaux apparaissent (propriété fiduciaire, patrimoine d'affectation, droit sur les volumes...), semblant mettre en cause certaines des institutions les plus traditionnelles : propriété, patrimoine, droit réel, personnalité. De plus, les biens immatériels connaissent un essor continu et deviennent les richesses contemporaines : propriétés intellectuelle, industrielle et commerciale, titres financiers, créances...
